About The Office of The County Clerk and Recorder

 
The County Clerk has many responsiblities in Marshall County Government. The County Clerk is the Election Official of the County, manages payroll, budget, tax extensions, delinquent taxes,  Clerk of the County Board, keeper of vital statistics, marriage licenses, notaries, assumed names, liquor licenses and economic interest statements.
 
The Marshall County Clerk also serves as the County Recorder and is responsible as the Recorder to make record of all deeds and instruments of title of property in Marshall County. Including but not limited to Warranty Deeds, Quit Claim Deeds, Cemetery Deeds,  Mortgages and Assignements, Releases, Plats, Easements, Assignments of Rents/Leases, Memos of Agreement, Liens and Judgements.

The FOIA Officer is the County Clerk, Hon. Andrea J. Mahoney-Platt. Vital Statistics
 
Vital Statistics are birth, death, marriage and civil union certificates.
 
Birth certificates may only be obtained by the mother or father on the birth record, legal guardian or by the child if 18 years of age. Photo id is required to obtain a birth record. Birth records date back to1867. Genealogical birth records may be obtained if the record is more than 75 years old.
 
Death certificate records date back to1877. Death Certificates may be obtained by any party with a legitimate interest. Genealogical death records must be on file at least 20 years before release.
 
Marriage records date back to 1839. A certified copy may be obtained by either the bride or the groom. Genealogical copies may be given if the marriage record has been on file for longer than 50 years.

Please note: Absolutely no information can be given over the telephone regarding Vital Records. Under Illinois State Law (410 ILCS 535-Vital Records Act) only specific individuals have legal access to birth, death, civil union or marriage certificates. The Marshall County Clerk’s office will issue certificates to authorized individuals only. To do otherwise is a violation of Illinois Law. Vital Records are not considered public information, nor are they subject to the Freedom of Information Act.

Marriage/Civil Union Licenses
 
Marriage/Civil Union licenses for anyone that will be married/civil union in Marshall County may be obtained from 8:30 a.m. to 4:15 p.m. at the Office of the County Clerk. Both parties must come in person to the office to fill out the marriage/civil union license application. The license may be used the following day and expires after 60 days. There is no blood test required and you must be at least 18 years of age. For a marriage license If you are under 18, both of your parents must be present when getting your license.
 
Marriage/Civil Union License fees are $75.00 cash. Effective June 1, 2011.
 
Any individuals making an application for a marriage/civil union license in Marshall County must provide identification with the name and date of birth of the applicant. (Driver’s license is sufficient) Also, anyone that had been married/or in a civil union previously will be asked to provide the date and county the previous divorce, invalidity of civil union or death occurred.
 
Notaries
 
Applications for Notaries must first be made through the Secretary of State. Our office will notify you upon its arrival and you may come in and personally sign the notary book for a fee of $5.00. If you are requesting by mail, send a letter of request, a check for $10.00 payable to the Marshall County Clerk, and a sample of your signature.

Liquor Licenses
 
The County Clerk is responsible for providing county liquor licenses to qualifying applicants upon receipt of a copy of the proper insurance fee.
 
           
Tax Extension
 
The Office of the County Clerk is responsible for the extension of property tax. Tax levies from all taxing bodies in Marshall County are filed in our office and available for viewing.
 
Delinquent Taxes
 
Delinquent taxes sold in Marshall County tax sales must be redeemed in the Office of the County Clerk in person or by mail. It is necessary to call our office to be assured of the exact amount of payment. Payment must be made in cash, certified check or money order made out to the Marshall County Clerk.
 
Assumed Name/DBA
 
The procedure for filing a certificate of Assumed Business Name is as follows:
Fill out the attached formhere which includes: the type of business to be conducted, business name, business address (Not a P.O. Box, must be a physical location) and the names and home addresses of the persons doing business. The persons doing business must sign (not print) their names in the middle of the form, above the section to be filled out by a notary. These signatures must be notarized.
Return the form to the Clerk’s Office.
The Fee for filing is $5.00. The publication fees with newspapers vary.
The Clerk’s Office will issue you a notice for you to take to any newspaper in Marshall County which has a legal notice section. The notice must be published one a week for three consecutive weeks. The first publication must appear within 15 days from the date the certificate is filed.
After our office is in receipt of the original certificate of publication from the respective newspaper, we will send you a copy along with a Certificate of Ownership of Business.
Certification of Registration will be considered VOID if the publication is not paid for and the certificate is not returned to the County Clerk’s Office within 50 days.
Currently, if you have a corporate, incorporated or limited business, you must file at the Office of the Secretary of State in Springfield, Illinois.

Elections
 
The Office of the County Clerk conducts all elections in Marshall County. Marshall County has approximately 9,000 registered voters and 16 precincts.
 
You may register to vote in the Office of the County Clerk, with a Deputy Registrar, or when receiving services at the Driver’s License Facility. It is necessary to provide two forms of identification when registering. One form must have your current address. You must be at least 18 years of age to register or will attain that age by the next election. The last day to register to vote is February 21, 2012 (except by Grace Period which runs from February 22, 2012 - March 13, 2012 when a voter may register or change his/her address but must vote at the same time as registering). The Marshall County Clerk’s office will be open Saturday, February 18, 2012 from 8:30 a.m. to noon for voter registration. The next election is the General Primary Election, March 20, 2012.

                     January 19, 2012 is the last day to submit the write-in declaration
An application for an absentee ballot is below. March 19, 2012 is the deadline for the County Clerk’s Office to receive an application for ballot. No ballots will be mailed to a voter after March 15, 2012. A voter may still absentee ballot in person at the Office of the County Clerk through March 19, 2012. Early voting will be conducted in the office of the Marshall County Clerk during regular business hours, excluding Holidays from February 27, 2012 through March 15, 2012 and open Saturday March 17, 2012 for absentee voting from 8:30 a.m. to noon.
